BandPlace is a product operated under the brand name "Empinet".
By accessing or using BandPlace, you agree to be bound by these Terms.
1. Description of Service
BandPlace provides a website-building platform designed for musicians and bands, including hosting, integrations, content management tools, and subscription-based features.
Some features may be in early access and subject to change.
2. Accounts
To access certain features, you must create an account.
You agree to:
- Provide accurate and complete information
- Keep your login credentials secure
- Be responsible for all activity under your account
We reserve the right to suspend or terminate accounts that violate these Terms.
3. Subscriptions and Payments
Certain features require a paid subscription.
Payments are processed securely through Stripe. We do not store full credit card details on our servers.
Subscriptions renew automatically unless canceled.
You may cancel at any time through your account dashboard. Access to paid features remains active until the end of the billing period.
We reserve the right to change pricing in the future. Changes will not affect active billing periods.
4. Acceptable Use
You agree not to:
- Upload or distribute unlawful, harmful, or infringing content
- Violate intellectual property rights
- Attempt to gain unauthorized access to the platform
- Interfere with or disrupt service functionality
- Use the platform for fraudulent or abusive purposes
We may remove content or suspend accounts that violate these rules.
5. User Content
You retain ownership of content you upload.
By uploading content, you grant us a limited license to host, process, and display that content solely for the purpose of operating the service.
You are solely responsible for the legality and accuracy of your content.
6. Availability
We aim to provide reliable service but do not guarantee uninterrupted or error-free operation.
BandPlace may undergo maintenance, updates, or feature changes at any time.
Early access features may change or be discontinued.
7. Limitation of Liability
To the extent permitted by law:
- We are not liable for indirect, incidental, or consequential damages
- We are not liable for loss of data, revenue, or business interruption
Liability under mandatory statutory provisions (including German law) remains unaffected.
8. Termination
You may terminate your account at any time.
We may suspend or terminate accounts that violate these Terms or applicable law.
Upon termination, your access to the platform will be revoked. Data retention may apply in accordance with legal obligations.
9. Intellectual Property
All platform software, design, branding, and technology remain the property of Mahdi Hezaveh IT Consulting unless otherwise stated.
You may not copy, reverse engineer, or redistribute any part of the platform without permission.
10. Changes to These Terms
We may update these Terms from time to time.
The latest version will always be available on this page. Continued use of the service constitutes acceptance of updated Terms.
11. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany.
If you are a consumer within the European Union, mandatory consumer protection rights under your local laws remain unaffected.
